A Norwegian court has decided to hand custody of the 5 year-old son of Irina Bergseth over to his father, who is suspected of the sexual assault of a child. The Commissioner for Children's Rights in the Russian Federation, Pavel Astakhov, did not manage to get permission to appear in court. However, the inspector for such important cases at the Head Institution of the Investigatory Committee of the Russian Federation agreed all the same to hear the trial. Irina's defence lawyer's appearance in court was termed "phenomenal", due to the fact that he managed to produce proof to the effect that the Russian woman's former husband had practiced sexual perversions with children. If there were serious facts which would have confirmed such similar actions, which had not been found in the course of the investigation, the representative of Investigatory Committee simply would not have been allowed to take part in the court process. According to all laws of human logic, the collection of evidence of the father's guilt should influence the court decision.

But the court decided to simply ignore it. As Irina says, "all documents and testimonials about the paedophilia which were presented from the Russian side were utterly excluded from the material pertaining to the case and did not figure in the Norwegian court's decision." However, there was a mention of the mother's possible "crimes"; the threat of taking the child to Russia. Evidently, for the Norwegian Justice System there could be nothing worse. "I am Russian and I want to live with my children in Russia.

Surely that's not a crime?" says Irina Bergseth, "It is actually the judge, Ingrid Smedsrud who has stolen my son away from me to Norway, and not the other way around. And now she is depriving me of my parental rights just because I live in Russia. The man was imprisoned for a year for sexual acts with his 11 year old daughter.

Even this unbelievably lenient sentence is surprising. But the after-effects even more so. The mother of the daughter, in shock, declared to the local television channel TV2 that it never even occurred to her that such a court decision could happen in Norway. "I feel that the trial will subject my daughter to even greater danger and violence," she said.

It seems that a paedophilic father, according to the Norwegian judicial system, is a much lesser threat than a Russian mother, who wants to take her child with her to Russia. After all this it was hardly surprising to read that the Australian publication on news.com.au, where a father, convicted of sexual acts with his 4 year old son, won a court decision to grant the father custody of his younger brother. As it says in the article, the court made the decision in spite of the conclusions of an expert, who had international experience of working with investigations into cases of child abuse, who claimed that the boy was subject to serious abuse. After a complaint by the mother, the four year old boy was also interrogated by police and told them what exactly his father had done to him. But all this evidence was not simply rejected by the court, it also deprived a mother of her custodial rights to her two children, giving them entirely to their father.

The mother is allowed only to occasionally come to see them. The woman declared to the press that she would never have taken her husband to court for sexual abuse if she had known that they would have taken her children away from her. It seems that if you don't want to lose your children, then you should stay silent, close your eyes to everything and do not count on the support or protection of the courts. Irina Bergseth also does not believe in the judicial system. But at least she is able to appeal the court's decision.
